Terms and Conditions

Your participation in any Vancouver Airport Authority (“Airport Authority”) Study, your joining the YVR Navigators Community, or your access to or use of any Survey Websites constitutes your agreement to these Terms and Conditions. If you do not accept and agree to be bound by these Terms and Conditions, then you must not participate in any Airport Authority Study, you must not join the YVR Navigators Community, and you must not access or use any Survey Websites.

1. Research Studies. From time to time, the Airport Authority or the Airport Authority’s service providers may conduct surveys, interviews, focus groups, or other research activities online or in-person on behalf of the Airport Authority or on behalf of third parties (each, a “Study”).
2. Customer Panel. The Airport Authority has established a customer and community panel to enable individuals to share their opinions about YVR experiences, facilities, services, and policies that may relate to them (the “YVR Navigators Community”). Individuals who join the YVR Navigators Community will receive regular invitations to participate in Studies.
3. Acceptance. By participating in any Study or by joining the YVR Navigators Community, or by accessing or using any website pages that relate to the Studies or the YVR Navigators Community, whether such website pages are hosted by the Airport Authority or by its service providers (collectively, the “Survey Websites”), you accept and agree to these Terms and Conditions.
4. Voluntary Participation. Your participation in any Study or the YVR Navigators Community is voluntary. You may choose to not participate and you may withdraw at any time.
5. Incorporated Terms. You agree that the Airport Authority’s website terms and conditions (https://www.yvr.ca/en/disclaimer) and privacy statement (https://www.yvr.ca/en/privacy) are incorporated by reference into these Terms and Conditions as if set out in full. For greater clarity, all references to “Website” in the Airport Authority’s website Terms and Conditions will be construed as including the Studies, YVR Navigators Community, and Survey Websites.
6. Amendments. These Terms and Conditions will be posted on the Airport Authority’s webpage for Customer and Community Research Opportunities (the “Website”). The “Last Updated” date below indicates when these Terms and Conditions were last amended. The Airport Authority may unilaterally amend these Terms and Conditions at any time by updating these Terms and Conditions on the Website. No amendment to these Terms and Conditions will be binding unless the Airport Authority has updated these Terms and Conditions on the Website. If you continue to participate in the Studies or the YVR Navigators Community or access or use the Survey Websites after amendment of these Terms and Conditions, you thereby accept and agree to the amended Terms and Conditions. You agree to review these Terms and Conditions regularly to determine your rights and responsibilities.
7. Study Rules. If you are invited to participate in a Study, then the Airport Authority may specify additional rules applicable to that Study (“Study Rules”). By participating in a Study, you accept and agree to any Study Rules applicable to that Study. The Airport Authority may unilaterally amend any Study Rules at any time, with notice to you before new Study Rules take effect. If you continue to participate in the Study, you thereby accept and agree to the amended Study Rules. You agree to review the Study Rules regularly to determine your rights and responsibilities. If a conflict or inconsistency exists between the Study Rules and these Terms and Conditions, then the Study Rules will prevail to the extent of the conflict or inconsistency.
8. Contest Rules. If the Airport Authority offers a contest related to a Study (each, a “Contest”), then the Airport Authority may specify additional rules applicable to that Contest (“Contest Rules”). By participating in a Study which has an associated Contest, you accept and agree to any Contest Rules applicable to that Contest. The Airport Authority may unilaterally amend any Contest Rules at any time, with or without notice to you. You agree to review the Contest Rules regularly to determine your rights and responsibilities. If a conflict or inconsistency exists between the Contest Rules and these Terms and Conditions, then the Contest Rules will prevail to the extent of the conflict or inconsistency.
9. Age of User. Individuals under the age of 16 are strictly prohibited from: (a) participating in Studies and the YVR Navigators Community; (b) using the Survey Websites; and (c) submitting any personally identifiable information to the Airport Authority in relation to a Study or the Survey Websites.
10. Survey Websites License. If the Airport Authority invites you to participate in a Study, then the Airport Authority grants to you a revocable, personal, limited, non-sublicensable, non-transferable, and non-exclusive license to access and use the applicable Survey Websites for the purpose of participating in the Study, as applicable, as permitted under these Terms and Conditions, subject to and conditional on your continued compliance with these Terms and Conditions. You may only participate in a Study, join the YVR Navigators Community, or use the Survey Websites for your personal use. You must not participate in a Study, join the YVR Navigators Community, or use the Survey Websites for any commercial or other non-personal purpose.
11. Study Responses. When you participate in a Study, join YVR Navigators Community, or use other features of the Survey Websites, you may provide information to the Airport Authority or its service providers (the information you provide is collectively called your “Study Responses”). For example, and without limitation, your Study Responses might include: (a) your responses to questions asked in a Study; or (b) information you provide that is used to determine whether to invite you to participate in a Study or to join the YVR Navigators Community. You agree that the Airport Authority may record and retain your Study Responses. You represent, warrant and agree that: (c) all information you provide in a Study Response will be true, accurate and complete; (d) you will not impersonate any person or misrepresent any affiliation; (e) you will only include the personal information of another individual in a Study Response if you have the express permission of that individual or if you are otherwise entitled to do so at law; and (f) you have obtained at your own expense all necessary consents, rights and permissions required to grant to the Airport Authority the license to Study Responses described below. If you are a member of the YVR Navigators Community, then, from time to time at the request of the Airport Authority, you will update or confirm the information you provided that is used by the Airport Authority to determine whether to invite you to participate in the YVR Navigators Community, or to participate in Studies sent to members of the YVR Navigators Community.
12. Confidentiality of Studies and Study Responses. You acknowledge and agree that the following will be the confidential information of the Airport Authority (“YVR Confidential Information”): (a) the topics of any Study; (b) the questions posed in any Study; (c) the questions posed to determine whether to invite you to participate in a Study or to join the YVR Navigators Community; (d) the Study Responses of any other person; and (e) your Study Responses (but only to the extent that your Study Responses would reveal any of the aforementioned information). You agree that, without the prior written approval of the Airport Authority, you will not disclose YVR Confidential Information to any person for any purpose, and you will not use YVR Confidential Information for any purpose other than participation in the applicable Study.
13. Research Reports. The Airport Authority and its service providers will use your Study Responses and the Study Responses of other Study participants to generate reports or other records or documents recording, describing or summarizing the Study Responses and what the Airport Authority has learned from the Study Responses (“Research Reports”). Some Research Reports are internal to the Airport Authority (“Internal Research Reports”) and are not intended for disclosure outside of the Airport Authority. Other Research Reports may be published generally or may be provided by the Airport Authority to specific other persons, such as auditors, regulators, Airport Authority business partners, or the third parties for whom a Study was conducted (“External Research Reports”). The Airport Authority will not include your name in any External Research Report, except with your permission. The Airport Authority will use commercially reasonable efforts to not include in any External Research Report any other information that could reasonably be expected to identify you, except with your permission. The Airport Authority will use commercially reasonable efforts to keep confidential any Internal Research Reports that include your name or that include any other information that could reasonably be expected to identify you. However, you acknowledge that any Study Response or Research Report might possibly be disclosed pursuant to an access request made by a third party under applicable freedom of information and privacy laws.
14. License to Study Responses. By providing a Study Response, you thereby grant to the Airport Authority an irrevocable, unlimited, sublicensable (through multiple tiers), transferable, royalty-free, worldwide, perpetual license to use, copy, distribute, modify, make derivative works from, and disclose the information and any other content in the Study Response, for any purpose whatsoever, and you hereby waive all related moral rights. All license rights so granted to the Airport Authority are subject to the Airport Authority’s compliance with its obligations under “Research Reports”. 15. Unacceptable Use. You agree that you will not make or submit, whether in any Study Response or in any other communication in relation to a Study or the YVR Navigators Community, any statement or other content that: (a) is obscene, indecent, vulgar, defamatory, abusive, harassing, racist, intimidating, hateful or otherwise objectionable; (b) contains language or images that typically would not be considered socially or professionally responsible or appropriate in person; (c) in any way infringes the rights of others; (d) encourages criminal conduct, or that might give rise to civil liability, or that otherwise violates any law; (e) impersonates any other person, whether actual or fictitious; (f) misrepresents your affiliation with any organization; (g) violates the privacy or publicity rights of any other person; (h) constitutes chain letters, pyramid schemes, junk mail, spam, or unauthorized advertising or promotional materials; and (i) is “off-topic” for a particular Study. You agree that you will not use any non-Airport Authority automation code to respond to any Study, including any “bot”, and that you will not respond to any Study more than once.
16. Focus Groups. Some Studies may be organized as focus groups, where participants may see or hear comments provided by other participants. If you participate in a focus group, your first name may be displayed to others in the focus group. Please remember that others may see or hear your comments. Please be careful what you post or say. Please do not share any information of a personal, sensitive, or financial nature in focus groups. The Airport Authority has no responsibility to you for any misuse of your comments by other participants, or for any inappropriate comments that may be made to you by other participants.
17. Termination for Convenience. The Airport Authority, in its sole discretion, at any time, for any reason or no reason, with or without notice to you, and without any liability to you or any other person, may terminate or suspend: (a) your continued participation in any Study; (b) your continued participation in the YVR Navigators Community; or (c) your license to use the Survey Websites. If the Airport Authority terminates or suspends your continued participation in a Study, your continued participation in the YVR Navigators Community, or your license to use the Survey Websites, then these Terms and Conditions will nevertheless continue to apply in respect of your participation in any Study, your participation in the YVR Navigators Community, and your use of the Survey Websites prior to such termination or suspension.
18. Severability. If any provision of these Terms and Conditions is unlawful, void or unenforceable, then that provision shall be deemed severed from the remaining provisions and shall not affect the validity and enforceability of the remaining provisions.
19. Cumulative Remedies. All rights and remedies of the Airport Authority granted or recognized in these Terms and Conditions are cumulative, are in addition to and not in substitution for any rights or remedies at law and may be exercised at any time and from time to time independently or in any combination.
20. Entire Agreement. These Terms and Conditions, together with any Study Rules and Contest Rules: (a) represent the entire agreement between you and the Airport Authority with respect to your participation in Studies or the YVR Navigators Community and your use of the Survey Websites; and (b) supersede all prior or contemporaneous terms, agreements, communications and proposals, whether electronic, oral, or written between you and the Airport Authority with respect to Studies, the YVR Navigators Community, and the Survey Websites.
21. No Waiver of Rights. Failure by the Airport Authority to insist on strict performance of any of the terms or conditions of these Terms and Conditions will not operate as a waiver by the Airport Authority of that or any subsequent default or failure of performance.
22. Assignment of Terms. You may not assign these Terms and Conditions without the prior written consent of the Airport Authority. The Airport Authority may assign these Terms and Conditions without restriction.
23. Enurement. These Terms and Conditions will enure to the benefit of and will be binding on you and the Airport Authority and your and its respective successors and permitted assigns.
